| Chapter 13 Bankruptcy Process Overview | |
Before Filing... |
Prior to filing you must complete some basic credit counseling. |
Day 1
Papers are filed to start the bankruptcy. Your papers must disclose all personal property and real estate you own, debts, and financial transactions for the past several years. You must also show you have filed your tax returns for the last four consecutive years. |
| Day 16 | A repayment plan showing how you intend to distribute your income among your creditors must be submitted within 15 days from the date you first filed your papers for bankruptcy. |
| Day 31 | Your first plan payment must be made. Your Trustee will be responsible for receiving the payment and distributing it among your creditors in accordance to your proposed repayment plan. |
Day 46
You will be required to attend a creditors' meeting in which the trustee will review your repayment plan and propose changes to the plan if necessary. Your Creditors may have a representative at this meeting to object to certain areas of your plan. Repayment plans usually aren't approved the first time through. |
Day 76
A confirmation hearing will be held in which the judge will rule as to whether your repayment plan is feasible and meets the standards for confirmation set forth in the Bankruptcy Code. |
Day 106
Often times repayment plans are rejected. In which case the repayment plan will need to be modified and a second confirmation hearing will be held around 30 days after the previous hearing. |
